TERMS AND CONDITIONS

These Terms and Conditions govern your access to and use of consciencedesigns.com and your purchase or use of products and services offered by Conscience Designs, LLC.

In these Terms and Conditions, “Conscience Designs,” “we,” “us,” and “our” refer to Conscience Designs, LLC. “Site” refers to consciencedesigns.com and the online services made available through it. “You” and “your” refer to any person who visits the Site, creates an account, places an order, submits content, or otherwise interacts with us.

By accessing or using the Site, creating an account, submitting content, or placing an order, you agree to these Terms and Conditions and acknowledge our Privacy Policy, Shipping Policy, Refund and Return Policy, and any additional terms presented at checkout or on a product page. If you do not agree, please do not use the Site or place an order.

ELIGIBILITY

You must be at least 18 years old or the age of legal majority where you live to create an account or place an order independently.

A person under the age of legal majority may use the Site or purchase products only with the involvement and permission of a parent or legal guardian. The parent or legal guardian is responsible for supervising the purchase and use of the products.

By using the Site or placing an order, you represent that you have the legal capacity and authority to agree to these Terms and Conditions.

Customers are responsible for using purchased products in accordance with applicable law and the directions and warnings provided with each product.

PRODUCT INFORMATION

We make reasonable efforts to provide accurate product descriptions, ingredients, directions, warnings, photographs, sizes, availability, and pricing.

Product packaging, labels, ingredients, colors, textures, appearance, quantities, and other details may be updated or may vary slightly from photographs or descriptions displayed on the Site. Device and screen settings may also affect how colors and product images appear.

Information presented on the Site is provided for general informational and shopping purposes. The product label and packaging accompanying the product contain the directions, warnings, active ingredients, and other information applicable to that product. Customers should review and follow the product label before use.

Website content is intended to supplement, not replace, the information provided on the product label.

If information on the Site conflicts with information on the current product label or packaging, stop using the product and contact us for clarification.

We reserve the right to correct errors, inaccuracies, or omissions and to update product information without prior notice. If a material error affects an order that has already been submitted, we may contact the customer, correct the order with the customer’s agreement, or cancel the affected order and issue an appropriate refund.

SKINCARE AND PRODUCT-USE INFORMATION

Conscience Designs provides cosmetic and personal-care products and may also offer products regulated as over-the-counter products, including sunscreen products.

Except for claims lawfully associated with an applicable over-the-counter product, including sunscreen products when properly labeled, statements made on the Site are not intended to diagnose, treat, cure, mitigate, or prevent a disease or medical condition. General product information and routine skincare guidance are not medical advice and should not replace advice from a qualified healthcare professional.

Individual results and experiences vary. A product’s suitability may depend on factors such as skin type, sensitivities, allergies, existing conditions, medications, other products being used, application method, frequency of use, and environmental conditions.

Review the complete ingredient list, directions, Drug Facts information where applicable, and warnings before using a product. If you have allergies, highly sensitive skin, a diagnosed skin condition, are pregnant or nursing, use prescription products, or have questions about whether a product is appropriate for you, consult a qualified healthcare professional before use.

When appropriate, consider testing a small amount of a new product on a limited area before broader use. Stop using a product and seek appropriate medical assistance if you experience a serious or persistent adverse reaction.

Products must be used only as directed and for their intended purposes. Keep products out of reach of children unless the label expressly states otherwise. Do not use a product after its expiration date or if the packaging appears damaged, altered, or contaminated.

SUNSCREEN PRODUCTS

Sunscreen products must be used according to the Drug Facts, directions, warnings, and other information provided on the product label.

Customers are responsible for applying and reapplying sunscreen as directed. No sunscreen blocks all ultraviolet radiation or eliminates all risks associated with sun exposure. Use additional sun-protection measures when appropriate.

Product descriptions and general skincare information on the Site do not replace the directions or warnings provided on a sunscreen product’s Drug Facts label.

ORDERS AND ACCEPTANCE

Submitting an order does not guarantee acceptance. An order is an offer to purchase the products identified at checkout.

We may accept, decline, limit, or cancel an order for legitimate business reasons, including:

• Product unavailability
• Pricing, description, or inventory errors
• Suspected fraud or unauthorized activity
• Payment-processing problems
• Address-verification problems
• Suspected resale or unauthorized commercial activity
• Violation of these Terms and Conditions
• Legal, regulatory, safety, or shipping restrictions

An automated order-confirmation message acknowledges that we received the order. It does not necessarily mean the order has been accepted or shipped.

If we cancel an order after payment has been authorized or collected, we will issue an appropriate refund to the original payment method. If the original payment method cannot accept the refund, we will follow the payment provider’s required refund procedure.

Checkout pages may be hosted, operated, or powered by Shopify or other ecommerce service providers. Additional checkout disclosures, payment-provider terms, tax calculations, fraud-screening rules, shipping options, or marketplace terms may apply to a particular transaction.

We may limit quantities purchased per person, household, account, payment method, billing address, shipping address, or order.

PRODUCT AVAILABILITY

Products and promotions are subject to availability. We may change, discontinue, restrict, or limit products, collections, sizes, packaging, promotions, or quantities without prior notice.

Placing an item in a shopping cart does not reserve the product or guarantee its availability or price.

If a product becomes unavailable after an order is submitted, we may contact the customer to offer an available option or cancel the unavailable portion of the order and issue an appropriate refund.

PRICING AND PAYMENT

Prices are displayed in United States dollars unless otherwise stated.

Prices, promotions, discounts, and product availability may differ between consciencedesigns.com and third-party marketplaces, retailers, resellers, or platforms.

Customers are responsible for reviewing the product price, shipping charges, taxes, discounts, and total purchase amount before completing an order.

Applicable taxes and shipping charges will be calculated or displayed during checkout when required.

We collect, report, and remit sales tax and other transaction taxes when required by applicable law. Tax amounts shown at checkout may depend on the shipping destination, product classification, taxability, exemptions, and the functionality of Shopify or other tax-calculation services.

We may correct pricing or calculation errors. If a pricing error affects a submitted order, we may contact the customer for approval of the corrected price or cancel the affected order and issue an appropriate refund.

Payment must be made using an accepted payment method. By submitting payment information, you represent that you are authorized to use the selected payment method and authorize the applicable charges.

You agree not to initiate chargebacks, payment disputes, or payment reversals that are fraudulent, abusive, or inconsistent with these Terms and Conditions, our policies, or the facts of the transaction. This does not limit any non-waivable rights you may have under applicable payment-card, consumer-protection, or dispute-resolution rules.

Payments may be processed by Shopify or another payment provider. We are not responsible for delays, declines, holds, or other actions taken independently by a financial institution or payment provider.

PROMOTIONS AND DISCOUNTS

Promotions, discount codes, free-shipping offers, gifts with purchase, and similar offers are subject to their stated terms, expiration dates, eligibility requirements, exclusions, and availability.

Unless expressly stated otherwise:

• Promotions cannot be combined
• Discounts cannot be applied retroactively
• Promotions have no cash value
• Promotions are not transferable
• Excluded or final-sale products do not qualify
• A promotion may be limited to one use per customer, household, account, or order

We may modify, suspend, or end a promotion when permitted by law. We may cancel or refuse a discount obtained through fraud, manipulation, technical error, or violation of the applicable promotion terms.

SHIPPING AND DELIVERY

Orders placed directly through the Site are subject to our Shipping Policy, which is incorporated into these Terms and Conditions.

Customers are responsible for providing a complete and accurate shipping address and reviewing available shipping methods, charges, processing information, and delivery estimates before completing an order.

Processing and delivery dates are estimates unless we expressly provide a written guarantee for a particular order. Delays may occur because of carrier operations, weather, emergencies, holidays, service interruptions, address problems, inventory issues, or other circumstances.

A package that is lost, damaged, delayed, misdirected, or marked delivered will be addressed under our Shipping Policy, Refund and Return Policy, applicable carrier procedures, and applicable law.

RETURNS, REFUNDS, AND CANCELLATIONS

Returns, refunds, replacements, exchanges, and order cancellations are governed by our Refund and Return Policy, which is incorporated into these Terms and Conditions.

Customers should review that policy before placing an order. Certain products, including the Discovery Collection and other sample or trial-size collections, are final sale and nonreturnable once shipped, except when Conscience Designs confirms that the order arrived damaged, defective, or incorrect.

An order-cancellation request is not guaranteed after an order has entered processing, been packed, generated a shipping label, or shipped.

CUSTOMER ACCOUNTS

Certain Site features may allow or require customers to create an account.

You are responsible for:

• Providing accurate and current account information
• Maintaining the confidentiality of your login credentials
• Restricting access to your account and devices
• Notifying us promptly of suspected unauthorized activity
• All activity occurring through your account to the extent permitted by law

You may not impersonate another person, create an account using false information, or use another person’s account without authorization.

We may suspend or terminate account access when reasonably necessary to protect customers, the Site, Conscience Designs, or others; investigate suspected fraud or misuse; comply with legal obligations; or enforce these Terms and Conditions.

We may use reasonable fraud-prevention, identity-verification, bot-detection, and payment-risk tools to protect customers, payment providers, carriers, and our business. These tools may delay or prevent order acceptance when a transaction appears unauthorized, incomplete, inaccurate, or suspicious.

PROHIBITED USES

You may not use the Site or its content to:

• Violate any applicable law or regulation
• Commit, encourage, or facilitate fraud or unlawful conduct
• Provide false, misleading, or fraudulent information
• Impersonate another person or misrepresent an affiliation
• Interfere with the Site’s operation, security, or availability
• Introduce viruses, malicious code, or harmful technology
• Attempt to gain unauthorized access to an account, system, network, or data
• Scrape, copy, harvest, or collect Site content or customer information through unauthorized automated means
• Circumvent security features, purchase limitations, or access restrictions
• Use the Site to transmit spam, harassment, threats, or unlawful material
• Infringe intellectual-property, privacy, publicity, or other legal rights
• Resell products in an unauthorized, deceptive, altered, or unlawful manner
• Remove, replace, obscure, or alter product labels, safety seals, expiration information, warnings, lot information, or packaging
• Use Conscience Designs’ name, trademarks, content, or products in a misleading manner
• Submit false reviews, fraudulent claims, or manipulated promotional activity

We may investigate suspected violations and take appropriate action, including restricting access, canceling affected orders, preserving relevant records, or reporting unlawful conduct when appropriate.

INTELLECTUAL PROPERTY

The Site and its content are owned by or licensed to Conscience Designs and are protected by applicable intellectual-property laws.

Protected content may include:

• Business and product names
• Logos and trademarks
• Product descriptions
• Photographs and graphics
• Videos and audio
• Website design and layout
• Written content
• Promotional materials
• Collections and arrangements of Site content

You may access and use the Site for personal, noncommercial shopping and informational purposes.

You may not reproduce, distribute, modify, publish, transmit, display, sell, license, create derivative works from, or commercially exploit Site content without our prior written permission or another lawful basis.

Nothing in these Terms and Conditions transfers ownership of Conscience Designs’ intellectual property or grants a license except for the limited personal use expressly described above.

REVIEWS AND OTHER CUSTOMER CONTENT

The Site may allow customers to submit reviews, comments, photographs, testimonials, questions, feedback, or other content.

You retain ownership of your original content. By submitting content to us or through the Site, you grant Conscience Designs a nonexclusive, worldwide, royalty-free, transferable, sublicensable license to use, reproduce, display, distribute, adapt, format, and publish that content for legitimate business, advertising, promotional, operational, and customer-service purposes, subject to applicable law and our Privacy Policy.

This license does not prevent you from using your own content elsewhere.

You represent that:

• You created the content or have permission to submit it
• The content reflects your honest opinion or experience
• The content is accurate to the best of your knowledge
• Any material connection, incentive, free product, discount, payment, employment, or personal relationship has been properly disclosed
• The content does not violate another person’s rights or applicable law
• The content does not contain malicious code, unlawful material, or private information belonging to another person

We do not require reviews to be positive. We will not penalize customers for submitting an honest review.

We may decline to publish or may remove content that is unlawful, fraudulent, unrelated, duplicative, threatening, harassing, obscene, defamatory, contains private information, infringes another person’s rights, includes malicious code, or violates these Terms and Conditions. We may also edit content for formatting or to remove personal information, provided the edit does not materially misrepresent the customer’s opinion.

We do not knowingly publish fake reviews, purchase positive or negative reviews, suppress honest negative reviews solely because they are unfavorable, or present a company-controlled review source as independent.

If a review, testimonial, endorsement, influencer post, employee statement, free product, discount, payment, affiliate relationship, or other material connection exists, it must be clearly and conspicuously disclosed where required by law.

We may request reviews only in a manner that seeks honest feedback and does not condition an incentive on a positive or negative opinion. If a review is incentivized, the incentive or material connection must be disclosed clearly and conspicuously where required.

We do not guarantee that customer content is accurate, complete, or representative of every customer’s experience.

Customer content may not include disease-treatment claims, unsupported product-performance claims, misleading before-and-after content, or statements that would make a cosmetic product appear to be an unapproved drug. We may remove or request changes to content that creates legal, safety, regulatory, privacy, or misleading-advertising concerns.

THIRD-PARTY LINKS AND SERVICES

The Site may contain links to or integrations with third-party websites, marketplaces, payment providers, shipping carriers, social media platforms, applications, or services.

Third-party services are governed by their own terms, policies, and practices. We do not control and are not responsible for third-party content, availability, security, products, services, or practices.

A link or integration does not necessarily constitute an endorsement. Customers should review the applicable third-party terms and policies before using those services.

Purchases made through Amazon, TikTok Shop, or another marketplace, retailer, reseller, or platform are governed by the terms and policies of the place where the purchase was made.

PRIVACY

Our collection, use, disclosure, and retention of personal information are described in our Privacy Policy.

By using the Site, you acknowledge that internet transmissions and electronic storage cannot be guaranteed to be completely secure. You are responsible for protecting your account credentials and notifying us of suspected unauthorized activity.

Customers are responsible for using secure devices, passwords, and networks when shopping online. We may use Shopify, payment processors, shipping carriers, analytics providers, email providers, and other service providers to operate the Site, process orders, prevent fraud, communicate with customers, and fulfill transactions as described in our Privacy Policy.

WEBSITE AVAILABILITY AND CHANGES

We may update, modify, suspend, restrict, or discontinue any portion of the Site when reasonably necessary for maintenance, security, legal compliance, operational changes, or other legitimate business purposes.

We do not guarantee that the Site will always be available, uninterrupted, secure, or error-free.

We may correct errors or restore service without prior notice. We are not responsible for temporary interruptions or technical problems outside our reasonable control.

DISCLAIMER OF WARRANTIES

To the fullest extent permitted by applicable law, the Site and its general informational content are provided on an “as is” and “as available” basis.

We do not warrant that:

• The Site will always be available, uninterrupted, secure, or error-free
• Site content will always be complete, current, or free from typographical errors
• A product will produce the same result for every customer
• General skincare information will be appropriate for every person or condition

Products remain subject to any warranties or protections that cannot lawfully be excluded, including applicable rights arising under consumer-protection law.

Nothing in these Terms and Conditions limits any non-waivable warranty, remedy, or consumer right provided by applicable law.

LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, Conscience Designs and its members, employees, agents, contractors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to use of the Site or products purchased through it.

To the fullest extent permitted by applicable law, our total liability for a claim arising from a particular purchase will not exceed the amount paid directly to Conscience Designs for the product giving rise to that claim.

These limitations do not apply where liability cannot lawfully be limited or excluded. Nothing in these Terms and Conditions excludes or limits liability for fraud, intentional misconduct, gross negligence, personal injury where such a limitation is prohibited, or any other liability that cannot be excluded under applicable law.

Some jurisdictions do not allow certain warranty disclaimers or limitations of liability. In those jurisdictions, the limitations apply only to the extent permitted by law.

The limitations in this section apply only to the extent permitted by Florida law, federal law, and any other applicable consumer-protection law. They are not intended to limit remedies that cannot lawfully be waived, including rights arising from deceptive, unfair, or unlawful business practices.

INDEMNIFICATION

To the extent permitted by applicable law, you agree to indemnify and hold Conscience Designs harmless from third-party claims, liabilities, losses, and reasonable expenses arising from your unlawful use of the Site, your violation of these Terms and Conditions, your infringement of another person’s rights, or content you submit.

This provision does not require a consumer to indemnify Conscience Designs for our own negligence, unlawful conduct, breach of these Terms and Conditions, or violation of applicable law.

GOVERNING LAW AND COURT JURISDICTION

These Terms and Conditions and disputes arising from or relating to them, the Site, or purchases made directly through the Site are governed by the laws of the State of Florida, without regard to conflict-of-law principles.

Any legal action that may properly be brought in court must be filed in a state court located in Pinellas County, Florida, or a federal court having jurisdiction over Pinellas County, Florida, unless applicable law requires a different location.

The parties consent to the jurisdiction of those courts, subject to any non-waivable consumer right to bring a claim in another proper jurisdiction.

These Terms and Conditions do not require mandatory arbitration and do not prevent either party from pursuing an eligible claim in small-claims court.

NOTICES AND ELECTRONIC COMMUNICATIONS

When you use the Site, place an order, create an account, or communicate with us electronically, you consent to receive transactional and service-related communications electronically, including order confirmations, shipping notices, policy notices, security messages, and responses to customer requests.

You are responsible for providing current and accurate contact information.

Marketing communications are subject to the choices and opt-out rights described in our Privacy Policy.

SEVERABILITY

If a court with proper jurisdiction determines that any provision of these Terms and Conditions is unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted or severed if necessary.

The remaining provisions will continue in effect.

NO WAIVER

Our failure to enforce a provision of these Terms and Conditions does not waive that provision or our right to enforce it later.

A waiver is effective only if it is in writing and applies only to the specific matter identified.

ASSIGNMENT

You may not transfer or assign your rights or obligations under these Terms and Conditions without our prior written consent.

We may transfer or assign our rights and obligations in connection with a merger, acquisition, restructuring, sale of assets, change in control, or transfer of the business, subject to applicable law.

ENTIRE AGREEMENT

These Terms and Conditions, together with the Privacy Policy, Shipping Policy, Refund and Return Policy, and any additional terms disclosed at checkout or in connection with a particular promotion, constitute the agreement between you and Conscience Designs regarding use of the Site and purchases made directly through it.

If a specific written term provided at checkout conflicts with these general Terms and Conditions, the more specific term will control for that transaction to the extent of the conflict.

CHANGES TO THESE TERMS AND CONDITIONS

We may update these Terms and Conditions to reflect changes in our business, products, Site features, service providers, or legal obligations.

The revised Terms and Conditions will be posted on the Site with an updated effective date. Changes apply prospectively unless applicable law permits or requires otherwise.

Your continued use of the Site after revised Terms and Conditions become effective constitutes acceptance of the revised terms to the extent permitted by law.
